ADC: When you have Dino Melaye, Online Baseless Lawyer as Your Legal Counsel

 

Suit No. FHC/ABJ/CS/1819/2025; (Nafiu Bala Gombe v. ADC & 4 Others), in which the question of the leadership of the ADC is being contested, is still pending before the Federal High Court, Abuja.

In the suit, Nafiu Bala Gombe sought an EX-PARTE ORDER, barring David Mark and others from parading themselves as national officers of the ADC and his (Nafiu Bala) recognition as National Chairman of the party.

Instead of granting this order EX-PARTE, the court had ruled that other parties in the matter be PUT ON NOTICE so that they can come and show reasons the ORDERS sought by Nafiu Bala Gombe should not be granted.

Rather than come to court to canvass strong legal arguments to prevent the court from granting the ORDERS sought by Nafiu Bala Gombe, Senator David Mark and others rushed to the Appeal Court.

The Appeal Court, in a unanimous decision, dismissed the appeal (CA/ABJ/145/2026) by David Mark and others as incompetent, upholding a preliminary objection challenging the court’s jurisdiction. The Appeal Court also ordered all parties to maintain STATUS QUO ANTE BELLUM, pending the final determination of the suit filed by Nafiu Bala Gombe at the Federal High Court.

David Mark and others filed an appeal at the Supreme Court against the ruling of the Court of Appeal.

Meanwhile, acting on the RULING of the Appeal Court, INEC withdrew recognition of the David Mark-led National Working Committee (NWC) of the ADC, choosing to deal with neither faction until the court case is resolved.

Now, David Mark and others again approached the Federal High Court in Abuja, seeking orders to compel INEC to reverse the decision it made based on the APPEAL COURT RULING.

#MY TAKE:
1. While at the Supreme Court on a matter, can you file another suit at the Federal High Court on the same matter?

2. By the Appeal Court ruling, hearing of Suit No. FHC/ABJ/CS/1819/2025; (Hon. Nafiu Bala Gombe v. ADC & 4 Ors), should commence at the Federal High Court.

3. Can you file another suit at the Federal High Court when there is a similar suit on which the Appeal Court has made pronouncements and you have filed appeal at the Supreme Court against the ruling?

4. Can the Federal High Court act as an appellate court over the Court of Appeal?

See enh, I am not a lawyer oo, but I have common sense, and that common sense is telling me that it is only when you have a Dino Melaye and another Online Baseless Lawyer as your legal counsel that you can be making all these expensive legal mistakes.
